Terms of Service

These Terms of Service ("Terms") govern your access to and use of the ALIGNMENT mobile application (the "App"), operated by Hikida Consulting, incorporated in British Columbia, Canada ("we," "us," or "our").

By accessing or using the App, you agree to be bound by these Terms. Your use of the App is also subject to Apple's Standard Licensed Application End User License Agreement (EULA).

1. Eligibility

You must be at least 16 years old to use the App. By using the App, you represent that you meet this requirement.

We do not knowingly permit individuals under 16 to use the App.

2. Description of Services

ALIGNMENT is a health and fitness tracking application that allows users to:

• Track workouts and physical activity
• Record nutrition and calorie intake
• Sync selected Apple Health data (with permission)
• Use AI-powered food analysis features
• Connect socially with other users
• Access subscription-based premium features

Free-tier users may be shown non-personalized advertisements. Premium subscribers receive an ad-free experience.

We may modify, suspend, or discontinue features at any time without prior notice.

3. Health & Medical Disclaimer

ALIGNMENT is not a medical device and does not provide medical advice.

All nutrition estimates, calorie calculations, AI-generated outputs, and fitness metrics are for informational purposes only and may be inaccurate.

You should consult a qualified healthcare professional before making health, nutrition, or exercise decisions.

Use of the App and participation in physical activity is at your own risk.

4. Assumption of Risk

You acknowledge that physical activity involves inherent risks, including injury, illness, or death. You voluntarily assume all risks associated with using the App and participating in activities tracked through the App.

We are not responsible for injuries, health complications, or damages resulting from your use of the App.

5. AI Features

The App includes AI-powered features that analyze food images and text descriptions.

You acknowledge that:

• AI-generated outputs may be inaccurate or incomplete
• Results should not be relied upon for medical decisions
• AI services are provided through third-party providers

We do not guarantee the accuracy or reliability of AI-generated outputs.

6. Subscriptions & Payments

Certain features require a paid subscription.

• Subscriptions are processed exclusively through Apple's in-app purchase system (StoreKit)
• Subscriptions automatically renew unless canceled
• You may manage or cancel subscriptions in your Apple ID settings
• Refunds are handled by Apple in accordance with their policies

We do not collect or store payment card information.

7. User Accounts

You are responsible for maintaining the confidentiality of your account credentials.

You agree to provide accurate information and keep it updated.

We reserve the right to suspend or terminate accounts for violations of these Terms.

8. User Content

You retain ownership of content you create within the App, including posts, workout entries, and nutrition logs.

You grant us a limited, non-exclusive, royalty-free license to use, store, and process your content solely to provide and improve the App.

You agree not to upload content that is unlawful, abusive, defamatory, infringing, or harmful.

We reserve the right to remove content at our discretion.

9. Prohibited Conduct

You may not:

• Reverse engineer or attempt to extract source code
• Circumvent subscription or payment systems
• Abuse or overload AI systems
• Upload harmful, illegal, or infringing content
• Harass, bully, or intimidate other users
• Impersonate another person or entity
• Use the App in a way that violates applicable laws

10. Intellectual Property

The App, including its software, design, trademarks, branding, and content (excluding user-generated content), is owned by Hikida Consulting.

You may not copy, reproduce, distribute, or create derivative works without our written permission.

11. Account Termination

You may delete your account at any time within the App.

We may suspend or terminate access if you violate these Terms.

Upon account deletion, your data will be removed in accordance with our Privacy Policy.

12. Disclaimer of Warranties

The App is provided on an "as is" and "as available" basis.

We make no warranties, express or implied, regarding:

• Accuracy of content
• Availability or uptime
• Error-free operation
• Fitness for a particular purpose

Use of the App is at your own risk.

13. Limitation of Liability

To the maximum extent permitted by law:

• Our total liability arising from or related to the App shall not exceed the amount you paid to us in the twelve (12) months preceding the claim
• We are not liable for indirect, incidental, consequential, special, or punitive damages

14. Indemnification

You agree to indemnify and hold harmless Hikida Consulting from any claims, losses, liabilities, damages, costs, or expenses arising from:

• Your use of the App
• Your violation of these Terms
• Your infringement of any third-party rights

15. Force Majeure

We are not liable for delays or failures resulting from causes beyond our reasonable control, including service outages, third-party provider failures, or natural events.

16. Governing Law

These Terms are governed by the laws of the Province of British Columbia and the federal laws of Canada applicable therein.

You agree that disputes shall be resolved in the courts located in British Columbia, Canada.

17. Severability

If any provision of these Terms is found unenforceable, the remaining provisions shall remain in full force and effect.

18. Changes to These Terms

We may update these Terms from time to time. Continued use of the App after changes become effective constitutes acceptance of the updated Terms.
